MASSOB'S NNAMDI KANU PRODUCED IN COURT BY NIGERIA SECURITY AGENCY

Mr. Nnamdi Kanu, operator of the UK based Radio Biafra and one of the leaders of the Movement for the Actualization of the Sovereign State of Biafra (MASSOB) was today, Monday, November 23, 2015 produced alive by the Nigeria State Security Service (SSS) in the Senior Magistrate Court, Wuse Zone 2, Abuja, Nigeria contrary to the earlier notion that he had been murdered.

Mr. Kanu entered a plea of Not Guilty to the 3 count charge of criminal conspiracy, intimidation and belonging to an unlawful society for which he is being tried.

The SSS, however, through its counsel, Moses Idakwo requested for the matter to be transferred to a court of higher jurisdiction, having found out that the accused was involved in and financing terrorism for which the magistrate court had no jurisdiction. He therefore asked for the discontinuation of the case by the magistrate as provided for in Section 108 of the Nigerian Criminal Justice Act.

The prosecuting counsel also informed the court that the SSS had obtained an order from the Federal High Court, Abuja dated November 10, 2015 to keep Mr. Kanu in custody for 90 days.

However, the accused's counsel objected to the request for the discontinuation of the matter stating that the prosecution did not present any information from the Attorney General of the Federation as provided for by the law. The accused's legal representative also informed the court that Mr. Kanu had not been allowed on bail even though he had met the conditions set by the court.

The matter was adjourned to December 1, 2015.
